    Except where otherwise specified, this privacy policy explains how CabinPanda manages your personal information and data and applies to all of CabinPanda, VAULTNING INC, and its affiliates (collectively, 'CabinPanda') goods, services, and websites. In this policy, CabinPanda products, services, and websites are referred to as the 'services'. All services are supplied by CabinPanda Inc., which is situated in the United States, unless otherwise stated.

    The terms 'you' and 'we,' 'us,' and 'our' refer to people who use and/or interact with any or all of CabinPanda's products, services, and websites. The term 'customer' refers to anyone who uses CabinPanda's services. Those who fill out and/or submit forms for our customers are referred to as 'Form Responders'.

  • Information Collected From Customers

    -Information about how to register: We collect your username, password, and email address when you create an account with us to create and/or utilize forms.
    -Information on billing: If you pay CabinPanda Inc., we need your billing information, which includes your name, address, email address, and financial information for the method of payment you choose (e.g. a credit card number and expiration date or a bank account number). If you submit a billing address, we will treat it as the account holder's address. Our interfaces with third-party payment gateways are solely for the purpose of processing. Any sensitive cardholder data given by you or your form users is not stored or logged by us. To secure the security of cardholder data during processing and transfer, we use industry-standard best practices. CabinPanda conducts annual audits to guarantee that our processing of your credit card information follows industry standards.
    -Data in a form: We use third-party server providers such as Amazon Web Services to store our customers' form data (questions and responses).
    -You own the data you use to create forms. Unless you make your forms available to the public, CabinPanda Inc. deems them as private. Except in a few limited cases, we don't sell or make forms you've generated available to anyone, and we don't utilize the form responses you collect for purposes unrelated to you or our services.

  • Information Collected From Visitors

    -Data about usage: When you use our services, we collect information about how you use them. This could include things like which websites you visit, what you click on, when you did those things, and so on. Additionally, our web servers, like most websites nowadays, store log files that capture data each time a device accesses them. The log files store information about each access, such as originating IP addresses, internet service providers, files viewed on our site (e.g., HTML pages, images), operating system versions, and timestamps.
    -Data from the device: We collect information such as your IP address, operating system version, device type, system and performance information, and browser type from the device and application you use to access our services. Your IP address may also be used to determine your geographic location.
    -Third-party sources of information: If you have given third parties permission to share your information, we may obtain your personal information or data from them.
    -Page tags provide information. We acquire aggregated and anonymized data on visitors to our websites through third-party tracking services that use cookies and page tags (also known as web beacons). This information provides statistics on usage and users. Page tags may be included in emails sent by CabinPanda or by users through our services, allowing the sender to collect information on who viewed the emails and clicked on the links inside them. We do this so that email senders can track the effectiveness of their messages and learn how to enhance deliverability and open rates.

  • Information Collected From our Form Responders

    We collect information about you and your usage of our services when you fill out or complete a form utilized by one of our Customers:

    -Prepare your responses: On behalf of our Customers, we collect and store the form responses you submit, in some cases using third-party server providers such as Amazon Web Services. This data is the responsibility of the form creator (Customer), and they are in charge of it. You may be asked to fill out a form with personal information or data. If you have any queries about a form that a Customer has emailed you or given you access to fill out, or the data that must be included in the form, please contact the form creator directly, since CabinPanda is not responsible for the form's content. It's possible that the form's creator has their own privacy policy.

    Is it true that your form responses are anonymous?

    -You'll have to consult the form's designer because it relies on how the person, corporation, or organization configured the form (s). We give form authors instructions on how to collect responses anonymously. Even if the form designer followed those steps, particular questions in the form may still ask for personal information or data that could be used to identify you.

  • How we use and disclose Customer Information

    -Unless a party other than CabinPanda has made that information public, we treat unique form questions and responses as private information. Without our Customers' approval, we do not utilize form data in ways other than those indicated in this privacy policy. We do not sell or make form data available to third parties without the authorization of the customer.

    We use data collected from and provided by our customers to provide the following services to them:

    Provide services and technical assistance, as well as aid them with form design and creation, technical troubleshooting, relationship management, and data collection on how they use our services.

    Certain parts of our services make extra use of the content of form inquiries and responses, as well as Customer account information. Where this is the case, feature descriptions will indicate it. Customers can opt out of the use of form data in this way by not using such features. When you use our form templates tool to add questions to forms, for example, you're allowing us to combine the responses you get to those questions with responses from other form templates users who have used the same questions. We may then send you and other form producers statistics about the aggregated (and de-identified) data we received.

    If you link your CabinPanda account to a third-party account, such as your Google or Facebook account, CabinPanda may utilize the information you give us from such third-party accounts to offer you with extra features, services, and personalized content.

    We may give you the option to export information to, and collect information from, third-party applications and websites, such as platforms like Google and Twitter and social networking sites like Facebook, in order to provide you with useful options for using the services with social media and other applications. You may be giving your information to the individuals or organizations responsible for operating and maintaining third-party applications and sites when exporting and collecting such information, and your information may be visible to others accessing or using such applications or sites. We do not own or run third-party applications or websites with which you interact; you should read the privacy policies and statements of such websites to ensure that you are okay with how they utilize the information you share with them.

    To keep track of our services. We only use your information for the following limited purposes, including certain form data:

    -Our services and features are monitored, maintained, and improved. To monitor and measure user activity and trends, we conduct statistical and other analyses on the data we gather internally, including usage data, device data, referral data, question and response data, and information from page tags, to learn how people use our services, and to monitor, debug, and enhance them, as well as to assist us in evaluating and designing new features Internally, we may use your information for troubleshooting and testing, as well as for service enhancement, marketing, research, and development.
    -To ensure that our Terms of Service are followed.
    -To keep illicit acts from happening.
    -To detect and avoid unwanted or aggressive behavior. We have automatic algorithms that check content for things like phishing, spam, and fraud, for example

    To develop new features, services, or content. We may use your form data and form metadata (data describing a form's attributes) for internal reasons such as developing and delivering new services, features, or content. Individual form creators and form respondents will not be identified or identifiable unless we have their permission to do so.

    To make the account creation and logon process easier. If you choose to link your CabinPanda account to a third-party account, such as your Google or Facebook account, we will utilize the information you gave us from those third-party accounts to help you create and login to your CabinPanda account.

    To get in touch with you regarding your service or account. We may send you transactional communications from time to time (e.g. service-related announcements, billing-related matters, changes to our services or policies, a welcome email when you first register). You cannot opt out of this form of contact because it is necessary for us to provide our services to you.

    To make marketing touch with you. Only if you have accepted to us contacting you for promotional purposes will we send you promotional emails. You can unsubscribe from these communications at any time by clicking the 'unsubscribe' link in them or changing the appropriate setting on your My Account page.

    Respond to legal requests while avoiding harm. If we get a subpoena or any legal request for information, we may need to examine the data we have on hand to decide the best course of action.

  • How we use and disclose Form Responder information

    Unless the responder has given the Customer who provided them with the form rights to that information, the personal information a form responder includes in a form belongs to the responder. If you have any questions, you should contact the Customer. The form creator is in charge of the submission data (the Customer). Unless the respondent and/or Customer have given permission, CabinPanda deems the information as private. To learn more about how the form author uses your responses, please contact them directly. When you complete a form, some form producers may give you with a privacy policy or notice, which you should read to understand how the form creator will treat your responses.

    We do not sell any of the personal information we collect from form submissions. We will not make form responses available to third parties without permission, and we will not contact form responders using any contact information obtained in our customers' forms.

  • How we use and disclose Website visitor information

    Regarding information on visitors to our websites, see the section above. We use the information, including cookies, customer data, usage data, device data, referral data, and information from page tags, to maintain and enhance our services, serve and support our Customers, conduct research, and for the other reasons indicated in this privacy policy.

  • Your information will not be sold or leased.

    Your personal information will not be sold or leased to anyone else. We may share aggregate demographic and statistical data with our commercial partners, but this data does not identify you personally.

  • General

    We may share information with third parties for the following restricted purposes:

    -Our service providers will have access to your information. We employ service providers to assist us in providing our services to you. We provide some of these companies' employees access to your information, but only to the extent that it is required for them to perform their jobs. Our service providers are required by contract to maintain technical safeguards to secure the confidentiality of your personal information and data, to use it exclusively to deliver services to us, and to treat it in line with this policy. Payment processors, hosting services, email service providers, and site traffic analytics tools are all examples of service providers.

    -Your account information will be sent to your billing contact. If your account holder information differs from the billing contact information stated for your account, we may reveal your name and account information to the billing contact if they request it. In most cases, we will try to notify you of such requests. You consent to this disclosure by using our services and agreeing to our privacy policy.

    -To improve or market our services, we may disclose aggregated or de-identified (anonymized) data to third parties. We do this to ensure that no identifiable people may be linked to any of the data we share with third parties in order to improve or advertise our services.

    -A cookie is used to market our services. We may request that advertising networks and exchanges place adverts on other websites promoting our services. We may ask such parties to deliver such adverts based on the existence of a cookie that was set on your computer when you visited one of our websites, but we will not share any other personal information with them. Our advertising network partners may also use cookies, page tags, and web beacons to collect non-personal information about your activities on this and other websites in order to deliver you relevant advertising based on your preferences.

    -If the law requires or allows it, we will share your information. We may share your information if we believe it is necessary to protect our rights, safeguard your safety or the safety of others, or to comply with a judicial procedure, court order, subpoena, or other legal demand served on us.

    -If the ownership or structure of your business changes, your information will be updated. You expressly consent to CabinPanda, transferring your information to the new owner or successor entity so that we can continue to provide our services if ownership of all or substantially all of our business changes, or if we undertake a corporate reorganization, including a merger, acquisition, consolidation, or any other action or transfer between CabinPanda entities.

    -You have given your express permission for your information to be shared. CabinPanda, for example, may ask for your explicit consent to share your contact information with third parties for a variety of reasons, including to allow those third parties to contact you for marketing purposes. You can remove your consent at any time, but if you want to stop receiving messages from a third party to whom we gave your information with your permission, you must contact that third party directly.

    Please be aware that if you are a form responder or a customer who has entrusted us with the protection of their personal information, we will not divulge or share it with third parties unless we have (a) given you notice, such as in this privacy policy, (b) secured your express consent, such as through an opt-in checkbox, or (c) de-identified or aggregated the data so that it could not reasonably be used to identify individuals or other entities. We will notify you before revealing your information if we are compelled by law to do so.

    You consent to the above-described disclosures by using our services or visiting our websites.

    In some situations, third parties manage the programs or user interfaces you see on our sites, and they may need you to give personal information. We have no control over the privacy policies of these third-party services or applications. Before using any third-party service, website, or application, we recommend reading the user terms and privacy statement.

  • How long do we keep your data?

    We keep your information for as long as you maintain an account with us, or as long as it is necessary to provide you with services, comply with our legal requirements, resolve disputes, or comply with and enforce our agreements. Data erased from our servers may persist as residual copies on offsite backup media for up to one month following deletion.

  • Requests to delete, amend, or withdraw consent for NON-EEA or UK Residents

    You may have the right to request that your personal information be deleted or amended. When consent is the legal basis for processing your personal data, you may also be able to withdraw your consent. Regardless of geographic location, we apply the same procedures, limitations, and exceptions established in this privacy policy for European Economic Area (EEA) and UK residents to all who make such requests to delete or amend personal information, or withdraw consent for processing personal information.   • Use of Your Information on a Legal Basis

    The following legal basis governs the processing of personal data that we collect:

    Our legitimate interests are at stake. This includes the following:

    -to allow us to provide you with our products and services, as well as access to and use of our website

    -for analytics, to collect metrics in order to better understand how people interact with our websites, and to assess and improve them

    Consent. Where permitted by law, we may use your personal information for marketing purposes with your consent in some situations (which you may withdraw at any time after giving it, as described in this privacy policy).

  • Deleting of personal information

    In certain instances, you may be able to request that we erase your personal information. If you wish to exercise this right, please use this form to make your request. All such requests will be considered, and we will respond within a reasonable time frame (but no longer than one calendar month from our receipt of your request unless we tell you that we are entitled to a longer period under applicable law). Before we answer your request, we may ask you to verify your identity.   • Access, Update, Data Portability and Other Rights

    You may also have the right to access your information, rectify any out-of-date or wrong information, restrict the use of your personal information in certain circumstances, and make a data portability request (applicable only when we use your personal information with your consent or in the performance of a contract, and when we use it by automated means), and ask us to take into account any valid objections you may have to our use of your personal information when we process it on the basis of our or another person's legitimate interests.

    Our websites are only for adults who are at least eighteen (18) years old. We do not collect personally-identifying information from children under the age of thirteen without their consent (13).
